The platform had submitted the request to Greece’s financial regulator, the HCMC, and according to Reuters it was already likely to be rejected. Instead of waiting for a formal denial, Binance decided to withdraw it and announced plans to seek authorisation in another EU member state.

The problem is that if that process starts now, there is no realistic way for it to be completed before July 1, 2026.

This means that Binance, the world’s largest exchange by volume with more than 300 million users worldwide, is entering the final stage of the MiCA transitional period without a confirmed CASP licence to operate in Europe.

If you have funds on Binance, this guide explains exactly what could happen, the possible scenarios, and what you should do before the end of the month.

What is MiCA and why does July 1 change everything

MiCA (Markets in Crypto-Assets Regulation, EU Regulation 2023/1114) is the European regulatory framework that requires all centralized exchanges to obtain a CASP licence (Crypto-Asset Service Provider) in order to offer services to users in the European Union.

The regulation entered into force on December 30, 2024, but granted an 18 month transitional period so that platforms already operating under previous national registrations could adapt.

Spain chose the maximum transition period. Platforms registered with the Bank of Spain before December 30, 2024 have been able to operate during this entire period without a full CASP licence. That deadline expires on June 30, 2026. From July 1 onward, supervision shifts from the Bank of Spain to the CNMV, and only entities with a MiCA authorisation issued by the CNMV or by another EU member state regulator will be allowed to legally provide services in Spain, operating via the European passport system.

The practical consequence is straightforward: from that date onward, any exchange without a licence that continues serving European users would be in breach of EU law and would be required to stop providing services to those customers.

The real state of Binance: what has happened and where it stands now

Binance had been working for more than 18 months to secure its MiCA licence. The chosen strategy was to submit its application to the Greek regulator (HCMC), a jurisdiction that several exchanges selected due to its faster approval timelines. According to Reuters on June 16, internal sources indicated that the application was likely to be rejected. That leak triggered alarm among European users.

On June 24, Binance confirmed what many had already anticipated: it withdrew its application in Greece before receiving a formal negative decision. The platform stated that it will continue pursuing a licence in another EU member state, but that new application, submitted at this stage, cannot realistically be completed before July 1.

Binance has promised an official update to its users before June 30, in which it will outline its contingency plan and the specific implications for each type of account.

As of the publication date of this article, Binance does not appear in the official ESMA register as an authorised CASP under MiCA. That is the only verification source that carries legal weight for European users.

What could happen to your funds: the three possible scenarios

The most important question for any Binance user in Spain is whether their funds are at risk. The honest answer is that there is no direct risk of losing funds due to MiCA, but there are concrete operational risks that are worth understanding.

Scenario 1: Orderly migration plan. This is the most likely scenario and the one the CNMV has established as mandatory for any exchange that does not obtain a licence before the deadline. The regulation requires the exchange to notify users in advance, set a reasonable withdrawal period, and provide the necessary tools to withdraw funds. If that deadline passes without action from the user, assets may be transferred to an authorised entity designated as part of a migration process supervised by the CNMV. In other words: your funds are not lost, but they may be moved to a platform you did not choose.

Scenario 2: Gradual restriction of services. Before any full shutdown, European users of Binance are likely to see certain features gradually restricted: limits on euro deposits, reduced access to specific products, and the inability to open new positions in services such as derivatives.

This has already happened partially in 2025, when Binance removed USDT for European users after Tether was unable to obtain the EMT licence required under MiCA.

Scenario 3: Securing a licence in another country before the impact fully materialises. Binance has not ruled out this path. If it manages to obtain authorisation in another EU member state in the coming weeks or months, it could restore full services for European users once approved. MiCA allows operations to resume as soon as the licence is granted, but not during any period in which the platform is unlicensed. This scenario depends on regulatory timelines that no exchange can fully control.

What the CNMV has made clear is that there will be no immediate freeze of funds on July 1. What may happen instead is a gradual degradation of services that could make it harder to manage your assets if you do not prepare in advance.

Why it is important not to wait: the real risk for users

There is a fundamental difference between having your funds physically safe and having the ability to use them freely. MiCA is not a confiscation risk. The real risk is different: being unable to sell during a period of volatility, not being able to withdraw in time, or having to go through the migration process in a rush and under less favourable conditions than if you act earlier.

In addition to operational considerations, there is a tax dimension worth taking into account. If Binance changes its legal entity, migrates your account, or restructures to comply with the new regulatory framework, access to your transaction history may be affected.

Before any changes occur, you should download and store locally your full transaction history: spot trades, deposits and withdrawals, staking, futures, and any tax reports available in your account. Not just for 2025 or 2026, but for every year you have been active on the platform.

This history is essential for correctly reporting to the tax authorities, and recovering it later can become significantly more difficult if the platform changes its structure.

What you should do before June 30

First, you should check the current status of your account and confirm whether Binance has already issued its official contingency plan announcement. The platform has promised to release this update before June 30, and it may include specific instructions on deadlines, withdrawal mechanisms, and options for migrating to authorised platforms.

If you have funds that you do not need to actively trade in the short term, the most prudent move is to transfer them either to a MiCA-licensed exchange or to a self-custody wallet before the end of the month.

Self-custody is always the option that completely removes reliance on third parties: if you move your Bitcoin or Ethereum to your own hardware wallet, MiCA does not affect you at all, since the regulation applies to intermediaries, not to users interacting directly with the network.

If you hold USDT, you should be aware that this asset is no longer available on any MiCA-licensed exchange in Europe, as Tether did not obtain the EMT authorisation required under the regulation.

Before migrating, you will need to convert your USDT into another cryptocurrency or into a MiCA-compliant stablecoin such as USDC or EURC.

If you decide to transfer to another exchange, make sure the destination platform has a confirmed CASP licence listed in the official ESMA register before sending any funds. Our list of MiCA-regulated exchanges includes the 21 platforms with confirmed authorisation as of today.

What happens if you do nothing before July 1

If you choose to wait, the main risk is not losing your money, but losing control over when and how you move it. The CNMV has stated that exchanges without a licence must facilitate an orderly exit for users, but the timing and conditions of that exit are set by the regulatory process, not by you.

In practice, this could mean having to accept the migration terms imposed at that moment, regardless of the platform involved or the deadlines set.

Trading on an exchange without a MiCA licence after July 1 also means giving up all the safeguards required by the regulation: segregation of funds, custody transparency, minimum regulatory capital requirements, and protections in the event of operational issues.

While these safeguards do not eliminate market risk, they do make a significant difference in the event of platform-related problems.

Frequently asked questions about Binance and MiCA

Are my funds on Binance blocked from July 1?

Not immediately. The regulation requires an orderly migration process with a reasonable withdrawal period before any assets can be immobilised. What may happen instead is a gradual restriction of operational features.

Can Binance obtain a MiCA licence after July 1?

Yes. MiCA is not a permanent ban: if Binance obtains authorisation in a new EU member state, it can resume serving European users from the day that licence is granted. The issue is the interim period, during which it cannot operate with full legal coverage in the EU.

Is Binance the same as Binance Europe?

Not necessarily. There are different entities within the Binance group, and the regulatory status of each one may vary. What matters for European users is checking the ESMA register to see which entity manages their account and whether that entity holds a valid CASP authorisation.

Do I have to report to the tax authorities if I move funds from Binance to another exchange?

Moving cryptocurrencies between wallets or exchanges is not, in itself, a taxable event in Spain.

What can create a tax obligation is swapping between different crypto assets during that process, for example converting USDT into another cryptocurrency before transferring it.

If you are unsure about your specific situation, it’s best to consult a tax advisor.

Do decentralized exchanges (DEX) and DeFi fall under MiCA?

Not in the same way. MiCA targets centralized intermediaries. If you interact directly with decentralized protocols such as Uniswap, Aave, or Curve using your own wallet, the regulation does not directly apply to you.

Self-custody of your private keys remains the only form of control that does not depend on any third party.

This article is updated as the regulatory situation evolves.
