How will cryptocurrencies be taxed in Spain in 2026?
Spain does not have a specific tax on cryptocurrencies: they are taxed under the general rules for personal income tax and estate tax. The key is to know when it is considered Treasury that you have «sold,» because the money doesn’t have to actually reach your account. Selling for euros, exchanging one cryptocurrency for another (for example, bitcoin for ether), converting to a stablecoin, or paying for something with cryptocurrency all count as a transfer, and if there’s a profit, it must be reported. Buying with euros or transferring funds between your own wallets is not taxable.
Depending on the source of your cryptocurrency, different taxes apply:
- Savings Base (trades and swaps): Here are the gains and losses from selling or exchanging. The tax rates are progressive: 19% up to €6,000, 21% up to €50,000, 23% up to €200,000, 27% up to €300,000, and 30% above that amount. Losses for the year offset gains, so you only pay tax on the net result.
- General basis (crypto activity or charges): If you mine cryptocurrency as a business activity, engage in professional trading, or are paid in cryptocurrency for work, that income is added to your salary and taxed according to the general tax scale, which for high incomes can range from 45% to 50% between the national government and the autonomous community. This is significantly higher than the savings tax bracket, which is why it’s important to distinguish between the two.
- Wealth Tax: Your cryptocurrencies are included in the value of your net worth as of December 31. State tax rates range from 0.2% to 3.5%, but each autonomous community can offer tax breaks or adjust the exemption threshold, so depending on where you live, this could affect you significantly or not at all.
- Model 721: If, as of December 31, you have more than €50,000 in cryptocurrencies held in custody by foreign platforms, you must file this informational return between January 1 and March 31 of the following year. It is not a tax, but the penalty for failing to file it is significant.
The European directive has been in effect since January 2026 DAC8: Exchanges are already collecting data from their customers and will submit the first reports in 2027—covering transactions from 2026—so the tax authorities can cross-check them with your tax return. The most sensible approach is to keep your own record of purchases, sales, and commissions, calculate your gains using the FIFO method (the oldest units are sold first), and report everything on Form 100 by June 30.

Regulation of cryptocurrency exchanges in Spain
Platforms that offer cryptocurrency services in Spain operate under European regulations MiCA, effective for service providers as of December 30, 2024. The CNMV It authorizes and supervises exchanges based in Spain, and the Bank of Spain supervises stablecoin issuers. Bit2Me was the first Spanish exchange authorized by the CNMV, in July 2025, and banks such as BBVA, Openbank, and CaixaBank have also received authorization.
The transition period ended on July 1, 2026, and since then, only platforms authorized by the CNMV or another European authority have been allowed to offer services in Spain. Binance, which withdrew its license application in Greece, has restricted its services for Spanish users: it only allows them to close positions and withdraw funds, and assures users that it will not freeze their assets. Before depositing money on an exchange, check that the entity providing the service is listed on the ESMA registration.
Important note: Binance does not appear in this ranking because it does not have a MiCA license. As of July 1, 2026, it is not accepting new users or deposits in Spain and only allows withdrawals.
