How will cryptocurrencies be taxed in Germany in 2026?
Germany does not have a specific tax on cryptocurrencies: they are considered «other assets» (sonstige Wirtschaftsgüter) and are taxed under § 23 EStG as private sales transactions. The key factor is the holding period, because that determines whether the gain is tax-exempt or not. Selling for euros, exchanging one cryptocurrency for another, or paying for something with cryptocurrency are considered taxable transfers if they occur within one year. Buying with euros or transferring funds between your own wallets is not taxable.
Depending on the type of transaction and the holding period, different rules apply:
- One-year speculation period: Gains from the sale or exchange of cryptocurrencies held for more than one year are fully exempt, with no limit on the amount, in accordance with § 23 EStG.
- €1,000 deductible (Freigrenze): If the sale occurs within the first year of ownership, the gains are taxed at the marginal personal income tax rate (up to 45%) only if they exceed €1,000 per year; if this amount is exceeded, the entire amount is taxed, not just the excess.
- Staking, mining, and lending: Such returns are considered «other income» under § 22 No. 3 of the Income Tax Act (EStG) and are taxed at their market value at the time of receipt, with a separate annual exemption of €256.
- Appendix SO: All taxable income is reported on Schedule SO of the income tax return (Einkommensteuererklärung), with income calculated using the FIFO method.
The European DAC8 directive has been in effect since January 2026: exchanges are already collecting their customers’ data and will submit the first reports in 2027—covering transactions from 2026—so that the Finanzamt can cross-reference them with your tax return. The most sensible approach is to keep your own record of purchases, sales, and acquisition dates, and to file your tax return with the Federal Central Tax Office by July 31 if you're doing it on your own.

Regulation of exchanges and cryptocurrencies in Germany
Platforms offering cryptocurrency services in Germany operate under the European MiCA regulation, which will apply to service providers as of December 30, 2024. The Bundesanstalt für Finanzdienstleistungsaufsicht (BaFin) authorizes and supervises crypto-asset service providers established in Germany, which account for about one-third of all MiCA licenses granted so far in the EU. Entities such as Bitpanda, Trade Republic, and Börse Stuttgart Digital (BISON) already hold MiCA licenses issued directly by BaFin.
The transition period ended on July 1, 2026, and since then, only platforms authorized by BaFin or another European authority with a MiCA passport may offer services in Germany. Binance, which withdrew its license application in Greece, has restricted its services throughout the EU, including Germany: it only allows users to close positions and withdraw funds, and assures users that it will not freeze their assets. Before depositing money on an exchange, check that the service provider is listed in the ESMA registry.
Important note: Binance does not appear in this ranking because it does not have a MiCA license. As of July 1, 2026, it will no longer accept new users or deposits in Germany and will only allow withdrawals.
