How are cryptocurrencies taxed in Portugal in 2026?
Portugal does not have a separate tax on cryptocurrencies: they are taxed through the IRS under the specific regime introduced by Law No. 24-D/2022, which has been in effect since 2023. The key factor is the holding period, because that determines whether the gain is exempt or not. Selling for euros, exchanging one cryptocurrency for another that is not equivalent, or paying for something with cryptocurrency may be considered a transaction subject to income tax. Buying with euros or transferring funds between your own wallets is not taxable.
Depending on the type of transaction and the holding period, different rules apply:
- Category G (less than 365 days): Capital gains from the sale or exchange of cryptoassets are taxed at a special rate of 28% and must be reported in Schedule G, Table 18-A, although taxpayers may choose to include them in their aggregate income.
- Category G1 (365 days or more): Capital gains are exempt from taxation, but they must still be reported in Schedule G1, Table 7, since the exemption does not eliminate the reporting requirement.
- Category B (professional activity): Whether the trading is regular and professional, or mining is carried out as an economic activity, the income is reported on Schedule B, using a coefficient of 15% under the simplified tax regime for the income earned.
- Appendix J (Foreign Brokers): Transactions involving cryptoassets held for less than 365 days through a foreign exchange are reported on Schedule J, Table 9.4 A, rather than Schedule G.
The European DAC8 directive has been in effect since January 2026: exchanges are already collecting their customers’ data and will submit the first reports in 2027—covering transactions from 2026—so that the Tax Authority can cross-reference them with your tax return. The most sensible approach is to keep your own record of purchases, sales, and acquisition dates, calculate capital gains using the FIFO method, and report everything on the IRS Form 3 between April 1 and June 30.

Regulation of exchanges and cryptocurrencies in Portugal
Platforms offering cryptocurrency services in Portugal operate under the European MiCA regulation, which applies to service providers as of December 30, 2024, and has been transposed into national law through Law No. 69/2025, dated December 22. The Bank of Portugal authorizes and supervises crypto-asset service providers (PSCA) established in the country, while the CMVM is responsible for supervising market abuse and the trading of crypto-assets on platforms where Portugal is the home Member State.
The transition period ended on July 1, 2026, and since then, only platforms authorized by the Bank of Portugal or by another European authority with a MiCA passport may offer services in Portugal. Binance, which withdrew its license application in Greece, has restricted its services throughout the EU, including Portugal: it only allows users to close positions and withdraw funds, and assures users that it will not freeze their assets. Before depositing money on an exchange, check that the service provider is listed in the ESMA registry.
